Congress passed and President has signed legislation that temporally suspends the penalty for seniors who failed to take the required minimum distribution from their IRA and or employer pension plans for 2009. But the penalty freeze which is part of the Worker, Retiree, Recovery Act of 2008, and does effect required distribution for 2008, which hit seniors hardest, and some say that 2009 will only help affluent seniors.
The government has been boasting that they want all people to save for their retirement and encourage it more and more. There is a penalty normally for failure to withdraw once the account owner reaches retirement age. Once the senior reaches the age of 70 ½ taxpayers must begin taking annual distribution from retirement accounts by April 1 occurring after they reach 70 ½ or the must pay a whopping 50% excise tax. On the amount they should have had distributed and was not. The amount that must be distributed is based on life expectancy and increases each year. For a senior who is 70 ½ should withdraw about 3.65 percent of the total account.
Today with the stock market plunging it estimating that some $2 Trillion has evaporated from the workplace retirement plans between 2007 and 2008, according to the Center for Retirement Research at Boston College. To assist seniors from being force to sell seriously devalued stocks in the worst market since 1931, Congress suspended the required distribution minimum for 2009, If you turned age 70 ½ before 2009, you would normally be required to take your 2009 monies by 12/31/2009. If you turn age 70 ½ in 2009, you would under the old way have to take distribution of funds by 04/01/2010. In either case, under the act you will not need to take this money. The new law waives distribution for beneficiaries of inherited IRAs and employer retirement accounts. But a taxpayer must still take their monies not later then 12/31/2010.
Important - Congress did not change the requirements for 2008, meaning that a senior must still take their 2008 monies by 12/31/2008. If they haven’t already the bill sponsors did not provide for 2008 because they expected the Treasury Department or the IRS to come up with a solution. The problem the agencies decided not to change the rule requiring seniors to withdraw monies form their accounts.
The senior taxpayer will be hit with a double whack because the total withdraws, are based on a percentage of what the IRA and 401k accounts were worth by the end of 2007. This is a big problem because that is when the Stock Market was well into five digits. If a senior was heavily invested in the stock market, they would have lost 30 to 40% of the value or the last year.
If seniors are forced to take the distributions with the amounts that their accounts have fallen this will place them in a major tax situation and placing them in a difficult financial bind.
The real problem is how can they fund this tax and still keep their portfolio in tacked; they can use tax free monies from a Reverse Mortgage. By taking out a Reverse Mortgage on the equity on their homes they can leave their Retirement accounts alone and wait for the markets to recover.

* Anyone whose annual income falls below the poverty line will immediately become eligible for a $10,000 outright grant.
* We will push through legislation that will allow homeowners to deduct from their taxes not only mortgage interest, but also the amount paid on the principal. Under this legislation, renters will be empowered to deduct their rent payments from their taxes.
* My administration will assure all minorities of unprecedented levels of representation throughout government, including the Cabinet.
One of our first steps after election will be to push through the Congress abortion laws that will please both pro-life and pro-choice. This will be followed by a Constitutional amendment.
If you like my platform, go to the polls and pull the lever with my name on it. Don’t worry about party lines; I may not have coattails but I can promise you that if I’m elected I will keep every one of my promises — and I won’t ask you to read my lips, either.
